New art or copyright infringement?

So is wrong, illegal, or just plain unfortunate when an artist takes an Associated Press photograph and makes it into something new? Would it matter if that image didn't have anything to do with the election of our new president?

That's what's going on with this AP photo of President Barack Obama, left, and the prolific image that artist Shepard Fairey created from it.

Fairey has admitted to using the AP photo, according to some of these articles. But he's saying that he created art from it - a new image.

Looking at these two, can we say that Fairey's take on the Obama picture is different enough to be considered a new image?

Is it art?
